Matthew Zwiren

Matthew Zwiren is a seasoned and dynamic Real Estate attorney who handles both real estate related transactions and litigation matters, specializing in both commercial and residential landlord-tenant litigation.

Matthew began his legal career as Associate General Counsel for a more than one hundred-year-old closely held real estate management and ownership company based in New York City.  Within two years he was named General Counsel and spearheaded the company’s legal department.  In his role as General Counsel, he provided guidance and advice on a wide range of matters, all while handling the company’s many transactions and its full landlord-tenant case docket.

Matthew took the experience garnered in his role as General Counsel and brought it into private practice, all while remaining responsible for litigating the company’s landlord-tenant case docket that often consists of over two hundred active cases.  To handle such a large caseload, he has developed operating procedures and policies in place to ensure efficient and effective case management, ensuring the numerous matters ongoing in different boroughs across New York City are zealously litigated.  In addition to handling numerous, concurrent landlord-tenant matters, Matthew also specializes in complex real estate transactions.

Matthew has been the lead attorney on multi-million-dollar commercial real estate purchases and sales that involve multifamily, triple-net retail assets, and development sites throughout the country, with a focus on the New York City metro area.  He also assisted in the acquisition of a New York City multifamily property through a tax lien auction.  Furthermore, Matthew is well-versed in 1031 tax-free exchange and reverse-1031 tax-free exchange transactions; completing exchanges that total well over eighteen million dollars in value.  Additionally, Matthew has a vast amount of experience with financing transactions, whether associated with an acquisition or a refinancing of owned property.  Indeed, Matthew was instrumental in successfully closing a 31-building, approximately $70M refinancing package for a multi-generational-family-owned real estate holding company, which allowed the client to realize millions of dollars in savings due to the interest rate lock terms Matthew negotiated.

Recently, Matthew assisted clients with a variety of real estate related matters.  Matthew has helped clients to acquire and development several build-to-rent/single-family-rental communities throughout the country, assisting with numerous legal aspects of these developments, including the drafting and negotiation of easements, bulk utility services agreements, closing bulk lot acquisitions, and the drafting of covenants, conditions, and restrictions to be recorded on the projects, with a focus on drafting creative and unique homeowners’ association declarations, by-laws, and regulations and structuring the homeowners’ associations to allow his clients to achieve their desired goals with the projects.  Further, Matthew has worked extensively with hospitality industry clients to draft, negotiate, and execute multi-million-dollar leases in prime Manhattan neighborhoods.  His creative drafting and negotiation skills have allowed clients to enjoy lease terms such as full liquor license receipt contingencies and favorable termination options in the event certain governmental permits or licenses are revoked.

As a complement to his experience closing commercial real estate transactions, Matthew has years of residential real estate experience.  Matthew has helped many families purchase and sell homes, ranging from first-time home buyers to experienced homeowners purchasing or selling a home, second home, or investment property.  Having completed residential transactions involving all types of properties from single family residences to condominium and cooperative units, he has the experience to bring all types of residential deals to the closing table.  His wide-ranging experience makes him knowledgeable about the real estate markets in both New York City and the surrounding suburbs.
