Nicole M. Ciolko

Nicole M. Ciolko is Of Counsel and a member of the firm’s Litigation, Tax Lien & Foreclosure, Financial Services, Creditors’ Rights, and Bankruptcy Practice groups. She represents investors, lenders, financial institutions, and servicers through every aspect of a case - from pre-commencement through redemption, sale, or other disposition.

Ms. Ciolko’s practice focuses on complex litigation in the areas of real estate, tax lien, mortgage foreclosure, and creditor’s rights in bankruptcy, intersecting with practice in the New York Surrogate Court, the Appellate Courts, and the Federal Bankruptcy Courts. She is experienced in drafting dispositive motions and appellate briefs, oral argument, discovery management, trial preparation, mediation, arbitration, and settlement. In addition to being admitted to practice law in the State of New York, Ms. Ciolko is admitted in the State of New Jersey, the United States District Court for the Southern, Eastern, and Western Districts of New York and the United States Bankruptcy Court for the Southern, Eastern, and Western Districts of New York.

In the past, Ms. Ciolko has litigated and managed complex general liability matters, where she was responsible for developing and implementing strategic litigation defense plans for high-exposure Labor Law, premises liability, and personal injury matters. She has also represented residential homeowners, purchasers, and tenants in real estate transactions and landlord-tenant proceedings.

  • Bankruptcy Money Judgment for the Non-Dischargeable amount of $4,288,119.00

  • Summary Judgment in Adversary Proceeding pursuant to 11 U.S.C. § 523(a)(2)(A), 11 U.S.C. § 523(a)(2)(B), and 11 U.S.C. § 523(a)(6)

  • Award of Summary Judgment against a municipality for negligence in connection with a pistol firing range owned and operated by the Village

  • Surrogate Decree Voiding Unconscionable Deed for a multi-million-dollar piece of real property from a NY Estate by those not actually entitled to inherit or transfer the assets by law

  • Second Department Appellate Division Decision Lifting improper Stay of Foreclosure impacted by corresponding Article 78 proceeding

  • Summary Judgment in Breach of Joint Venture for the development of multiple million-dollar real property

  • Appointment of administrators in long-deceased estates without fiduciaries accumulating tax debt and other liabilities
